The decision to avoid the prosecution of Jessie Smollett is a pretense. Smollett’s hoax amounts to racial declinations against Caucasians as wells as national origin discrimination. In addition, the false police report is a crime because co-conspirators testified to the crime. There is video footage of the Nigerians admitting to it, and video footage of them purchasing the rope.
The prosecutor admited that Smollett is guilty of a racist and homophobic attack. They stated they do not believe he is innocent.
Prosecutorial discretion is broad. Prosecuting selectivity is subject to constitutional constraints. The decision not to prosecute may not be based on race, religion, or other arbitrary statute.
The reality is the prosecutors dropped the cases because Smollett is black and a member of the SJW and LGBT Community.
There has been a lot of prosecutorial misconduct in the case. The decision not to prosecute violates the US Crime Victims Rights Act. This acts grants the victim to be reasonably protected from the accused. The right to reasonable notice of court proceeding. And parole proceeding, or any release or escape of the accused. The right to not be excluded from any public court proceeding. This part is important because the prosecutors knew they were guilty of corruption so they sealed the case so no one could see the corruption.
When prosecutors fail to charge false accusers they are enabling and asking for more false accusers. More importantly, the real victims of the said crime will get less resources and there will be a “boy who cried wolf effect” with the real victims of said crime.
In addition to this, by not prosecuting they are promoting racial and national origin discrimination.
This prosecutor and their entire office should be sued in federal court.
In addition, any prosecutor in this case should be disbarred for racially motivated corruption and enabling it.
