- Tell the investigators to fuck off and you want hire an attorney.
- Invoke your 5th amendment right to remain silent because 9 times out of 10, they are accusing you of a crime. If you wave your right to remain silent or council and you start admitting things that you are innocent of, its over.
- Never confess what “you did wrong.” This is a sexual harassment witch hunt claim. The reality is that in this #metoo environment, if both of you are intoxicated and you are a man and she is a women. You are a rapist and she is not. - Do not provide records like personal email or texts. Let them get a court order to go on a fishing expedition. What you do outside of work is your business and not your employers.
- Never apologize to anything. Apologizing is consent of guilt which gives you legal liability. It does not matter if it “makes people feel better.” If you are innocent, why do you have to apologize. Also if you take a stand now, you are not letting this woman do this to another man in the future.
WHAT TO DO IF YOU ARE FALSELY ACCUSED AND YOU CAN DEMONSTRATE INNOCENCE.
If there is not a smoking gun of evidence, I would encourage you go after them. And if any prosecutor decides to go after you, I would sue them in federal court immediately during the trial. You don’t want to be in a situation where you have waved your statute of limitations because they have falsely imprisoned you, and now you have no recourse. You sue for defamation and slander, malicious prosecution, and false imprisonment.
