After two years of bouncing through the courts DDJ has finally made the Writ to the US Supreme Court. The Writ was filed on September 15, 2021 and was accepted after the court reviewed it. Just so we are clear, almost all writes submitted to SCOTUS are rejected.
There are are 8000 cases filed with SCOTUS each year. 130 get accepted to the Cert Pool, and 80 get tried each year.
The next hurdle is for the writ to be set for trial. Lets us all pray that two Justices want this to be heard by the court. We will know in three to six months!
DDJ is suing, in part, on the following grounds:
- 42 U.S.C. § 1983, however, DDJ is doing it with a twist. He is claiming Google/YouTube are state actors of multiple foreign governments. The discrimination DDJ alleges is based on national origin discrimination, religion, freedom to associate, and other 1st Amendment claims.
- 42 U.S.C. § 2000a, this is based on the fact YouTube is an online theater and the discrimination is national origin discrimination
- Challenging 47 U.S.C. § 230 as unconstitutional
- Fraud: Google/YouTube lies about their terms of service.
- Google/YouTube’s contracts are unconscionable. This means they are unfair and the court should rule them unenforceable.
